1. Governance: What’s New?

In the first of our Scheme Sessions for 2022, Jason Coates (Head of Pensions, Gowling WLG) chairs a discussion on what’s new and what’s on the horizon for trustees in 2022.

In particular, focusing on the new Single Code and what trustees should be doing to prepare for that. In this context, we get insight from Louise Sivyer from The Pensions Regulator on its expectations of trustees and talk to her about the requirement for an Own Risk Assessment.

Sarah Horan (Independent Trustee Services) covers another hot topic for trustees: diversity and inclusion on the trustee board and, from her experience, the practical steps that trustees can take to ensure they are operating as effectively as possible.

2. The New Transfer Regime

In our second Scheme Session, we focus on the new transfer regulations and how trustees and administrators are dealing with the obligations in practice.

Maddy Frost (Legal Director, Gowling WLG) talks about:

• live issues that trustees are currently grappling with;
• “safe lists”; and
• the “risk-based approach” to decision-making advocated by The Pensions Regulator.

We also hear from Margaret Snowdon OBE on these issues and get her insight on best practice.

3. Governance: Don’t forget the basics

In the third and final session of our 2022 series of Scheme Sessions, we review the basics of good governance, including:

• decision making;
• managing conflicts;
• trustee minutes; and
• ways to mitigate risk.

We identify some of the common pitfalls we see in practice and the potential consequences when mistakes are made. As specialists in pensions disputes, Charlotte Scholes (Principal Associate, Gowling WLG) and Nicholas Hill (Barrister, Outer Temple Chambers) share their experience and give practical advice.
