The judges have been appointed (Unified Patent Court judicial appointments and Presidium elections | Unified Patent Court (unified-patent-court.org), and finalisation of the case management systems and UPC website appear to be progressing – the UPC is well on its way to becoming a reality (and the latest expectations are that 1 April 2023 may be the start date).
In our article, How far can the UPC reach? | Gowling WLG , we have explored some important jurisdictional questions around the “reach” of the UPC, which are bound to arise in the first few months and years of its life. The scope of the UPC is a key question and one that we, as UK solicitors, have been keen to explore. In the article we look at different categories of countries which will come into being on commencement on the UPC and provide our views as to the effect of the UPC in each. We don’t have answers to all the issues just yet but look forward to seeing how they are addressed in due course.
